Moreover, as per the new law, the employer will have to compensate the employee with up to three months\u2019 salary. This was explained by the first appeal judge and head of the technical office of the Labour Court, Dubai Courts, Judge Dr Ali Muhammad Al Hosani.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to Al Hosani, the reasons for dismissal can be if the employee:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Submits false documentation.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Fails to follow the employer\u2019s instructions.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Fails to perform their duties.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Reveals the employer\u2019s business secrets or confidential information to third parties.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">In addition, employers can also dismiss employees if they:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Are under the influence of certain psycho-active substances, such as alcohol and illegal drugs at work.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Commit immoral activities at their workplace.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Abuse their employer or colleagues verbally or physically.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Are absent from work for 7 consecutive days or 20 non-consecutive days.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">On the other hand, employees can also terminate the contract without notice in case their employer:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Does not fulfill the conditions laid down in the <\/span><a href=\"https:\/\/connectresources.ae\/everything-you-should-know-about-an-international-employment-contract\/\"><span style=\"font-weight: 400;\">employment contract<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Assaults them.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Assigns them other duties or work without their consent.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">In case the employer does not serve the notice period to their employee, it will be mandatory to provide monetary compensation. Furthermore, it is against the new <\/span><b>UAE <a href=\"https:\/\/connectresources.ae\/oman-labour-law\/\" data-wpil-monitor-id=\"1091\">Labour Law<\/a><\/b><span style=\"font-weight: 400;\"> to dismiss an employee for filing a complaint against the employer.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"2_Does_the_new_law_make_the_termination_of_work_contracts_more_flexible\"><\/span><strong>2. Al Hosani spoke at the second forum for employers (organized by the LSDA or Labour Standards Development Authority in Sharjah). This insightful session was attended by more than 300 establishment owners and managers.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">One of the things that he mentioned was that the new law gives more flexibility to both parties in terminating the relationship. Furthermore, he also explained that it does not require the completion of the contract term. The law also allows both parties to terminate the relationship by giving two warnings by the law\u2019s regulation.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It is worth mentioning that the Federal Decree Law No. 33 of 2021 on the regulation of labour relations in the private sector came into force on February 2, 2022. According to the government, the new <\/span>Labour Law will enhance employment rights. Besides, it will also boost the competitiveness of the Emirates as a place to live and work.<\/p>\n<p>As a result, it will help the region to <a href=\"https:\/\/connectresources.ae\/the-greatest-strategies-on-how-to-attract-passive-but-highly-qualified-employees-to-your-team\/\">attract and retain world-class talent<\/a>. Furthermore, the new UAE Labour Law<span style=\"font-weight: 400;\"> makes provision for companies to put in place part-time and <\/span><a href=\"https:\/\/connectresources.ae\/new-uae-labor-law-2022-employees-can-now-have-part-time-jobs-with-flexible-work-contracts\/\"><span style=\"font-weight: 400;\">flexible working arrangements<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"3_Why_is_a_written_contractual_agreement_important_in_the_UAE\"><\/span><strong>3. There are cases in which the salary is deposited via the WPS and withdrawn from the employee\u2019s account in one minute. How many vital facets of the new UAE Labour Law should you be aware of?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><img decoding=\"async\" class=\"size-full wp-image-13101 aligncenter\" src=\"https:\/\/connectresources.ae\/wp-content\/uploads\/2022\/07\/UAE-Labour-Law-1.jpg\" alt=\"\" width=\"1024\" height=\"640\" srcset=\"https:\/\/connectresources.ae\/wp-content\/uploads\/2022\/07\/UAE-Labour-Law-1.jpg 1024w, https:\/\/connectresources.ae\/wp-content\/uploads\/2022\/07\/UAE-Labour-Law-1-300x188.jpg 300w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/p>\n<p><span style=\"font-weight: 400;\">Besides the previously mentioned details of the new <\/span>UAE Labour Law<span style=\"font-weight: 400;\">, there are some other ones you should know about, including:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Employers cannot keep the passports of their employees since it is illegal.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Employers must pay for recruitment, <a href=\"https:\/\/connectresources.ae\/visa-government-services\/\">visa<\/a>\u00a0and <\/span><a href=\"https:\/\/connectresources.ae\/a-13-step-guide-to-getting-a-work-permit-in-dubai-uae\/\"><span style=\"font-weight: 400;\">work permit<\/span><\/a><span style=\"font-weight: 400;\">, in addition to other legal costs of hiring new employees. Therefore, the employer cannot cut these expenses from the employees\u2019 salaries.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The company must pay for medical treatment expenses and insurance fees.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The experience certificate must be non-biased. Besides, it must not be written in a manner that jeopardizes future employment options for the employees.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">When it comes to paying salaries, there cannot be delays. <\/span><a href=\"https:\/\/connectresources.ae\/uae-labour-laws-the-new-penalties-for-late-payment-of-salaries\/\"><span style=\"font-weight: 400;\">Late payment of salaries<\/span><\/a><span style=\"font-weight: 400;\"> can bring negative consequences, including fines and other penalties.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Employers are not allowed to force employees into doing work or completing duties they are not comfortable doing.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It is illegal for employers to force employees to work long hours. In case employees <\/span><span style=\"font-weight: 400;\">work overtime<\/span><span style=\"font-weight: 400;\">, they must get <a href=\"https:\/\/connectresources.ae\/how-to-calculate-overtime-as-per-uae-labour-law\/\">fair compensation<\/a> as per the law.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The law will not tolerate bullying, harassment, and emotional and sexual abuse in the workplace. An example of emotional abuse can be if <\/span><span style=\"font-weight: 400;\">an employer says &#8216;your value is nothing to me&#8217; to an employee.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">There is a minimum <\/span><a href=\"https:\/\/connectresources.ae\/uae-labour-law-when-can-employees-leave-a-job-without-notice\/\"><span style=\"font-weight: 400;\">notice period<\/span><\/a><span style=\"font-weight: 400;\"> of 30 days. Nonetheless, there is now a maximum notice period of 90 days. For those employees who leave while still employed on unlimited term contracts, minimum notice periods apply of:<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">30 days for employees who have worked for the company for up to 5 years.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">60 days for employees who have worked for the company between 5 and 10 years.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">90 days for employees who have worked for the company for 10 years or more.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h3><strong>4.1. Other essential details of the new UAE Labour Law<\/strong><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Those employees summarily dismissed are not entitled to a notice period or <\/span><a href=\"https:\/\/connectresources.ae\/the-new-end-of-service-savings-scheme-for-ex-pats-in-dubai\/\">end-of-service gratuity<\/a>. However, there are two additional rules to the old Labour Law<span style=\"font-weight: 400;\">, which are abusing the position to obtain personal profits and gains. And the second one is joining another establishment without complying with controls and procedures in place.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A written investigation, as well as written warnings, must be provided before an employee is dismissed.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Before terminating an employee\u2019s contract, they must conduct an inquiry.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The employer must give two warning letters to the employee before terminating their contract. Plus, the employer must also provide an apparent reason for dismissal before terminating the contract.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">An employee cannot be dismissed for consuming alcohol and other substances. However, they can fire them for consuming them during work timings.
